Welcome to Drayman's Brewery. These Terms of Service ("Terms") govern your use of our website, located at www.draymans.com, and all related services provided by Drayman's Brewery ("we," "us," or "our"). By accessing or using our website and services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website.

1. Introduction & Acceptance of Terms

Drayman's Brewery is a family-owned craft brewery and distillery based in Silverton, Pretoria, Gauteng, South Africa. Founded in 1997, we have been proudly serving South African craft beer, spirits, whisky, and coffee enthusiasts for nearly three decades. These Terms constitute a legally binding agreement between you and Drayman's Brewery regarding your use of our website and services. By placing an order, creating an account, or simply browsing our website, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. We reserve the right to modify these Terms at any time, and continued use of our website following any such modifications constitutes your acceptance of the updated Terms.

2. Definitions

Throughout these Terms, the following definitions apply:

"We," "us," or "our" refers to Drayman's Brewery, its owners, directors, employees, and affiliates.

"You," "your," "customer," or "user" refers to any person accessing or using our website, whether or not they place an order.

"Website" refers to www.draymans.com and all subpages, features, and functionality offered therein.

"Products" refers to all items available for purchase on our website, including but not limited to craft beer, spirits, whisky, coffee, and related merchandise.

"Services" refers to all services provided by Drayman's Brewery, including but not limited to online sales, order processing, delivery, and customer support.

"Order" refers to any purchase request placed through our website for one or more products.

3. Eligibility & Age Verification

Drayman's Brewery sells alcohol products, and as such, we are required to comply with South African liquor legislation. You must be 18 years of age or older to purchase alcohol from our website. By placing an order for any alcohol product, you confirm and warrant that you are at least 18 years of age. You also agree not to purchase alcohol products on behalf of any person under the age of 18.

Upon delivery, our couriers are instructed to verify the age of the recipient. A valid South African identity document, driver's license, or passport may be required to confirm your age. If the recipient appears to be under 18 years of age and cannot provide satisfactory identification, our courier reserves the right to refuse delivery. In such cases, the order will be returned to Drayman's Brewery, and a refund will be processed in accordance with our Returns & Refunds policy.

We take our legal obligations regarding alcohol sales seriously. Any attempt to circumvent age verification measures, including but not limited to providing false information, ordering alcohol for delivery to an address where minors may receive it, or any other fraudulent activity related to age verification, will result in immediate cancellation of your order and may be reported to relevant authorities.

4. Account Registration

To place orders on our website, you may need to create an account through Shopify, our e-commerce platform provider. When creating an account, you agree to provide accurate, current, and complete information about yourself. You are solely responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. Drayman's Brewery cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

5. Products & Pricing

Drayman's Brewery strives to describe our products as accurately as possible, including detailed descriptions, images, and information about alcohol content, volume, and ingredients. However, we do not warrant that product descriptions or other content on our website are accurate, complete, reliable, current, or error-free. Our products include craft beers such as Emperor IPA, Kaizen Lager, Altstadt Weissbier, Düssel Altbier, Goblin's Bitter, Jolly Monk Rauchbier, Berghof German Ale, Cherry Ale, The Krémist Vanilla Cream Ale, and Craft Beer Mixed Pack; spirits including Hakkiesdraad Mampoer in Peach, Marula, Litchi, and Cherry flavours, as well as Honigjäger Honey Liqueur; Single Malt Whisky and our blended Protea Smoked Whisky.

All prices are displayed in South African Rand (ZAR) and include applicable taxes unless otherwise stated. We reserve the right to correct any errors in pricing, even after an order has been placed or confirmed. If a pricing error is discovered, we will notify you and provide you with the option to reconfirm your order at the correct price or cancel your order for a full refund. Product availability is subject to change without notice, and we reserve the right to limit quantities available for purchase and to refuse or cancel any order, in our sole discretion.

6. Orders & Acceptance

When you place an order through our website, you are making an offer to purchase the products selected at the prices indicated. All orders are subject to availability and our acceptance. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, payment issues, suspected fraud, or suspected violation of these Terms or applicable law. If we cancel your order, we will notify you by email and process a full refund to your original payment method. Upon order confirmation, you will receive an email summarizing your order details. This confirmation email does not constitute acceptance of your order; acceptance occurs when we dispatch the products to you.

7. Payment Terms

We accept the following payment methods: credit cards, debit cards, and Electronic Funds Transfer (EFT). All payments are processed securely through Shopify, our e-commerce platform provider, PAYFAST. Your payment is processed securely using SSL encryption to protect your personal and financial information. Payment must be received in full before your order is dispatched. For credit and debit card payments, your card will be charged at the time of order placement. For EFT payments, you will receive our banking details, and your order will only be processed upon receipt of payment clearance. Please note that EFT payments may take 2-3 business days to clear.

8. Delivery & Shipping

We deliver throughout South Africa only. Delivery is handled by our courier partners, with the following terms and timeframes:

Free delivery in Gauteng on orders over R650.00 (ZAR).

Gauteng: 2-3 business days from dispatch.

Other major centers: 3-5 business days from dispatch.

Remote areas: 5-7 business days from dispatch.

Please note that "business days" means Monday to Friday, excluding South African public holidays. Orders placed on weekends or public holidays will be processed on the next business day. Once your order is dispatched, you will receive a tracking number via email, which you can use to monitor the progress of your delivery.

Risk of loss and damage passes to you upon delivery of the products to your specified address. Please inspect your package upon delivery and contact us immediately if any products are damaged during transit. As stated in Section 3, age verification will be required upon delivery for all alcohol orders, and our courier reserves the right to refuse delivery if the recipient cannot verify they are 18 years of age or older.

9. Returns & Refunds

Drayman's Brewery stands behind the quality of our products with a full money-back guarantee or product replacement policy. We want you to be completely satisfied with your purchase. If you are not happy with your order for any reason, please contact us within 30 days of receiving your order to arrange a return or exchange.

For damaged items, please photograph the damage and contact us within 7 Days of receiving your order. Include clear photographs showing the damaged packaging and/or product, along with your order number. We will investigate and process your claim promptly. Subject to our investigation confirming the damage, we will arrange for a replacement or refund at our discretion.

Refunds will be processed within 5-7 business days after we receive the returned products (if applicable) and confirm the validity of your claim. Refunds will be credited to your original payment method. Our no-fuss returns policy is designed to ensure your complete satisfaction with every purchase.

10. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, product descriptions, trademarks, service marks, and trade names, is the exclusive property of Drayman's Brewery or its content suppliers and is protected by South African and international intellectual property laws. The "Drayman's Brewery" name, logo, and all related brands, products, and product names are trademarks of Drayman's Brewery. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from our website without our prior written consent. Any unauthorized use of our intellectual property may constitute infringement and may be subject to legal action.

11. User Conduct

When using our website, you agree to:

12. Limitation of Liability

To the fullest extent permitted by applicable South African law, Drayman's Brewery, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, or loss of goodwill, arising out of or related to your use of our website or services. Our total liability for any claim arising from or related to your order shall not exceed the total amount paid by you for the products in question. This limitation of liability applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded under applicable law. Your statutory rights as a consumer under South African law, including rights under the Consumer Protection Act, are not affected by these Terms.

We collect and process personal information in accordance with the Protection of Personal Information Act (POPIA), South Africa's primary data protection legislation. The personal information we collect includes, but is not limited to, your name, email address, phone number, physical delivery address, and payment information. This information is collected for the purpose of processing your orders, arranging deliveries, and providing customer support.

Drayman's Brewery uses Shopify as our e-commerce platform provider, and Shopify Payments and other approved payment gateways for payment processing. These third-party services have their own terms and conditions, and your use of these services is subject to their respective terms.

16. Promotions & Gift Cards

Drayman's Brewery offers gift cards that can be purchased on our website. Gift cards are redeemable for products on our website and have no expiry date unless otherwise stated. Gift cards cannot be converted to cash and cannot be refunded. Promotional offers, discounts, and special deals may be offered from time to time and are subject to specific terms and conditions applicable to each promotion. Please refer to the specific terms of each promotion for details regarding eligibility, validity periods, and any restrictions.

17. Responsible Drinking

Drayman's Brewery is committed to promoting responsible drinking. Alcohol can only be purchased and consumed by persons 18 years of age or older. Excessive or irresponsible alcohol consumption can cause serious health problems and addiction. We encourage all our customers to drink responsibly and in moderation.

Please note: Do not drink and drive. If you are pregnant, planning pregnancy, or have a medical condition affected by alcohol consumption, please consult your healthcare provider before consuming alcohol. Our products are not suitable for persons under 18 years of age. Your continued use of our website following any such changes constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically for any changes. If you do not agree to the updated Terms, you should cease using our website and contact us to cancel any pending orders.

19. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles. As a South African business, we comply with all applicable South African legislation, including but not limited to the Consumer Protection Act (CPA), the Protection of Personal Information Act (POPIA), and liquor legislation governing the sale of alcohol.

Any dispute, controversy, or claim arising out of or relating to these Terms, your use of our website, or your orders shall first be attempted to be resolved through friendly negotiations between you and Drayman's Brewery. If a dispute cannot be resolved through negotiations within 30 days, either party may refer the matter to the National Consumer Commission or pursue legal action in the appropriate South African court of law. You have the right to approach the Consumer Tribunal or a consumer court with jurisdiction for relief under the Consumer Protection Act.
